Real Estate Houses – Foam and Concrete Walls?

 

I understand that houses are being made with concrete/foam block walls.  This newer technology increases the energy efficiency, security and strength of houses.  This new design is part of a construction method called stay-in-place-forms or insulated-concrete forms.

 

This construction creates one of the strongest and most energy-efficient houses that are possible today.  The walls can resist hurricane force winds.  Concrete itself is not a good insulator.  When the concrete is encased in foam, you gain energy efficiency.  The concrete itself provides the strength and helps reduce the amount of noise that penetrates the walls of the house.

 

Energy efficiency is enhanced when air leakage in and out of the house is reduced.  Since the house is built with concrete, it will remain airtight over time since concrete does not settle.  While the walls will be thicker than normal, this won’t be noticeable.  Should you look closely at the window and door openings, you will see they are slightly wider. 

 

Currently there are several designs of houses available.  One company has a system you can use for floors.  The cost will be determined by the quality of the insulation that is used.  The higher level will cost more.  As the technology catches on and is used more, the costs associated with it will decrease.

Real Estate Ownership - Condominium or Fee Simple

 

Usually, apartment-style buildings are known as condos, two-story row houses are referred to as townhomes while free-standing homes on small lots are called garden homes.  Sadly, this definition makes little confusion around real estate ownership.  Apartment, garden home, and townhome refer to the design or construction of some homes.  The word "condominium" does not imply the style or layout of a building.  A condominium is a form of ownership of real estate.  The system of ownership of real estate cannot be known by looking at the building design.  

Condominium System

The legal meaning of condominium is:  the total ownership of a unit based on a legal description of the airspace the unit, in reality, occupies, as well as a complete interest in the ownership of the mutual elements, which are owned together with the other condominium unit owners.

Each unit owner of a condominium has a different title to the space in his unit.  Space is sometimes labeled as beginning with “the paint on the walls.”  Additionally, each unit owner has an undivided interest in the physical components of the condominium buildings and land.

A well-known type of condominium development is the multi-story apartment.  In this example, there is no land under each unit.  In these developments, the condo association regularly handles maintenances of the outside building and mutual grounds, while the unit owners maintain the interiors of their units.

A condominium may be built as two units of a duplex.  In such case, the two owners may together come up with decisions regarding maintenance of any common areas.  By setting up the units of a duplex as two condos, the owner is able to sell them to two different owners.

All condominium has rules that are precise to the development, so no assumptions should be made concerning their requirements.  It is essential to read the condominium documents wisely before acquiring a condo.  The documents stipulate the maintenance that is covered by the mutual budget.  In one project, the association may handle external components, pools, decks, driveways, and sidewalks. 

In another, the different owners may be responsible for more maintenance of their units, including roofs, foundations, and exterior walls.

Fee Simple Ownership

Unlike the condominium regime, you may own property by fee simple.  “Fee”, derives from the word, “fiefdom”, translate to legal rights in land, and “simple” means unrestricted.  Fee simple is the most popular type of ownership.  It is the legal title to real property that is complete, comprising both land and buildings.

In fee simple, there are numerous different opportunities with respect to your duties of ownership:

(a)  Your property may not be in a subdivision whatsoever.  In this case, your deed will not comprise any subdivision boundaries that limit your use of the property.  Understand that there could be some deed limitations put in place by former owners.  In addition to deed limitations, you may be governed by city or county decrees or zoning laws that restrict your use of the property.

(b)  Your real estate may be in a subdivision with very few restrictions, no architectural control committee, no mutual areas and no mandatory dues.  Usually, these are older subdivisions. 

(c)  Your real estate may be located in a subdivision of homes on large lots, or located in a town home or garden-home community where there is a legal created homeowners association.  In this scenario, every homeowner is required to be a member of the association.  The association may require compulsory dues and impose rules on the subdivision.  A certain level of management may be required of each property owner.  For instance, you may need association approval of external paint colors, barriers, or additions to your home.        

Like the condominium form of ownership, fee simple ownership does not set how maintenance is handled or how developments are governed.  For instance, the owners of a townhouse, with fee simple ownership, may be needed to fully maintain their units. 

Otherwise, the owners' association may take care of roofing, painting, and yard work for the owners.  In subdivisions where single-family homes are on a large lot, it is very common for the homeowners association to manage the common grounds, parks, and pools, while the individual lot owners fully maintain their own properties. 

Understand your ownership rights and obligations

Before going into a condominium regime investment or buying fee simple property, you should have a good knowledge of the kind of ownership you will have in your estate.  If you are getting a condominium, it would be clever to read the condo papers thoroughly and be knowledgeable about how maintenance is shared among the separate owners and the condominium association. 

In the event that your ownership is fee simple, with personal ownership of the property, you should assess the deed limitations (in case they are any) and know the limitations and duties that are applicable to your property.  In the fee simple form of ownership, there may be compulsory dues to pay for common area repairs, or, in some scenarios, the fees may be used for part repairs of the different properties. 

In case you have questions about your type of title or about your duties as an owner, it would be clever to evaluate the property documents with a real estate lawyer before moving on with your purchase.  Ask sufficient questions!  A strong understanding of your type of ownership, and of your obligations as a homeowner will bring about a more fulfilling real estate purchase.

Though not every home selling contract follows the same standard, most of them should answer the below questions:

-          What’s being sold? A description of the property being sold

-          How much is the property?

-          How is the contingency of mortgage? An amount or a mortgage rate is needed.

-          How much will the deposit be and whom will it be given to?

-          When and where is the closing?

-          What is the exact scope of the selling? A home selling contract, in its essence, should give a firm limit of what’s being sold and what’s not.

-          Will the seller be able to do further home inspections?

-          What kind of inspections (wellness, hygiene, and termite inspection) will be done?

-          Is there any insurance covering the house?

Give extra attention to the unforeseen event, as this is typically the most important part of a home selling contract. The home buyers would want to ensure that if something happens in the house before closing, they would have a way to back out without penalty. Ensure that you as the seller is equally unharmed by this.

The tough job is, even after you understand the main elements of a home selling contracts, you might experience difficulty in designing one for your transaction. Looking for a new rental property can be a daunting task; chances are good that if you are searching for a property online you may be looking to move to a new area of the country for work or family reasons.  Even if you are not moving to a new area but are looking to move to another property in the same region it can still be a big task.

What methods are there to help with the search?

There are still the more traditional methods open to rental house hunters which will include the local papers (if you are in the area to receive one) or visit the letting agent's offices directly.  These are still valuable methods but can be time-consuming or impossible depending on your situation. 

To visit the local letting agents may take a whole day or even worse a whole weekend, depending on where you are living and where you are moving too, plus there are no guarantees that you will find what you are looking for.  If you set out a weekend to look for a property it could be likely that a knee-jerk reaction could happen if you become desperate to find a property during the time you are there.

 

One of the most important things to remember is that you need to take your time, don’t leave your hunt to the last minute, this could result in you having to accept a property that is not ideal for your requirements.  It is important to remember the more time you leave for your search the more selective you can be when choosing your rental property.

How do the Property Portals/Directories Help Me

In days gone by the portal sites and directory sites that advertised property were often found to be frustrating to use, you may have found the house or flat that you would like to take a look at, make contact with the agents only for them to announce that the property had already gone and the site was outdated. 

The portals have now become much more sophisticated and are as up to date as the agent's own websites.  Taking feeds automatically from the agents own databases on a daily basis often the property found is current, OK, so you may be unlucky and have selected a property that had already gone that day, however more often than not this won't be the case.

The information on these sites is good and provide full property details, location maps, landlord requirements (ie/ no smoking, dss, pets) and even have the facility to download the property details so you can review your top selections in your own time offline.  The rental market has always been a step behind the sales market when it comes to particulars and advertising documents, this now is not the case and you will find that rental property online is documented as well as sales.  The good sites will also provide agent profile pages which outline their services and also give you a link through to their company website so you can check for further information.

Are Rentals Still Second Behind Sales

A lot of sites are focused on sales and estate agents and have the rentals as a side issue.  The rentals market is an entirely different market and is aimed towards a different sector of people, it is important that the marketing online and offline is aimed towards the correct demographic group.  There are specialist sites which are aimed purely towards the rental market of which it would make sense to use these services first.  As always there are some better sites to use than others and it makes sense to research each one and check as many properties as you can (online) first.

Reviewing the Information be Prepared

As stated in the earlier part of this article remember to take your time in searching for property, decide on what is important for you.  Don’t go into this blind; be prepared as you would if you were buying a house, a bad decision at the beginning of the process could mean you spend 6 months (usual minimum tenancy agreement length) in a house/flat or an area that you would rather not be in.
